8. Costs
The costs for filing and prosecuting IP rights are often difficult to estimate. Indeed, they may vary according to the performed formalities , which themselves depend upon the complexity of the subject matter, on the time spent for performing formalities, on the agent's competence and on the language used in performing these formalities.
Other aspects like the choice of countries where you want to obtain protection, the chosen way of protection (national, regional, international) as well as the length of texts to be drawn up, may determine the overall cost.
In addition, important fluctuations of costs may intervene. They are the result of an increase of official fees and changes in exchange rates.
However, an estimation of costs can be provided before any intervention is undertaken. These estimations take into account our own fees, the official fees at the date of the calculation of the estimation, the exchange rates at that particular moment and where appropriate, possible refunds of official fees.
Whenever patent proceedures (national filing, European filing, community filing, international filing, etc.) turn out to be complex and diverse, the total procedural cost (incurred over a period of 5 years) up to the grant of a European patent may amount to EUR 25 000,- whereas the charges to be foreseen until the grant of an American patent amount to at least EUR 15 000,-.
